| UAPA Amendment 2019 | 2019 | The Unlawful Activities (Prevention) Amendment Act, 2019 expanded the designation framework from terrorist organisations to individuals. Sections 5 and 12 amended section 35 and added the Fourth Schedule for individual names, while organisations remain associated with the First Schedule. Section 6 also amended section 36 to include applications concerning removal of an individual’s name and the related review process. The Act received assent on 8 August 2019; particular listings require their own notifications rather than being inferred from the amending Act. | When analysing an Al-Qaeda-linked network, distinguish the organisation, a named individual and the conduct alleged against that person. An organisational designation and an individual designation use different statutory lists; the 2019 Act did not automatically enter every alleged affiliate in the Fourth Schedule. The change also makes the removal provisions relevant to individuals. In an exam answer, identify the exact instrument and person or organisation instead of treating a network label as proof of a particular listing or criminal conviction. This entry explains the statutory architecture and does not assert a current list of designated persons. |
