Preamble — Basic Structure
Basic Structure
The Preamble to the Indian Constitution is the introductory statement that embodies the fundamental philosophy and objectives of the Indian state. Beginning with 'We, the People of India,' it establishes popular sovereignty and declares India as a Sovereign Socialist Secular Democratic Republic.
The Preamble outlines four core objectives: Justice (social, economic, political), Liberty (thought, expression, belief, faith, worship), Equality (status, opportunity), and Fraternity (dignity of individual, unity and integrity of nation).
Originally adopted on November 26, 1949, it was amended once in 1976 through the 42nd Amendment, which added 'Socialist,' 'Secular,' and 'integrity.' The Supreme Court in Kesavananda Bharati (1973) established that the Preamble is part of the Constitution and can be amended but not in ways that destroy its basic structure.
While non-justiciable, it serves as a crucial interpretive tool for understanding constitutional provisions and has been used in landmark judgments to expand fundamental rights and guide policy decisions.
The Preamble reflects the vision of creating a just, equitable, and unified nation that balances individual rights with collective welfare, making it the philosophical cornerstone of Indian democracy.
