Constitutional Framework — Revision Notes
⚡ 30-Second Revision
- Part III: Fundamental Rights; Article 32 remedy.
- Part IV: Directive Principles; Article 37 governing importance and non-justiciability.
- Article 226: High Court writ jurisdiction has wider purposes.
- Article 368: special majority; State ratification for specified matters.
2-Minute Revision
For a constitutional question, identify the actor, power, procedure, limit and remedy. Keep rights distinct from directives and ordinary administration distinct from constitutional amendment. Read enabling language and conditions rather than inferring powers from an institution's general importance. A strong answer explains how the provisions work together in the decision being examined.
5-Minute Revision
A hypothetical amendment receives more than two-thirds of members present and voting but less than a majority of the House's total membership. Test it against Article 368's parliamentary requirement. Then ask whether the subject also falls within the State-ratification proviso. Explain why satisfying one numerical condition does not settle the complete procedure.
