National Emergency under Article 352 is the most serious form of emergency provision in the Indian Constitution, allowing the Central Government to assume extraordinary powers when the nation's security is threatened.
Think of it as a constitutional mechanism that temporarily transforms India from a federal structure to a unitary one during times of grave crisis. The President can declare a National Emergency on three specific grounds: war, external aggression, or armed rebellion.
However, this power is not absolute - the President can only act on the written advice of the Union Cabinet, and Parliament must approve the proclamation within one month. Once declared, a National Emergency has far-reaching consequences: it suspends the normal distribution of powers between the Centre and States, allows the Central Government to give directions to any State, and can lead to the suspension of fundamental rights guaranteed under Article 19 (freedom of speech, assembly, movement, etc.
). The emergency can also suspend other fundamental rights through a separate Presidential order under Article 359, except the rights to life and personal liberty under Articles 20 and 21. However, the 1975-77 Emergency period under Prime Minister Indira Gandhi demonstrated how these provisions could be misused for political purposes, leading to significant constitutional amendments in 1978.
The 44th Constitutional Amendment introduced crucial safeguards: the term 'internal disturbance' was replaced with 'armed rebellion' to prevent misuse, the President must now act only on written Cabinet advice, and Parliament's role in approval and review was strengthened.
