The National Commission for Scheduled Castes (NCSC) is a vital constitutional body in India, established with the primary objective of safeguarding the interests of the Scheduled Castes (SCs). It acts as a watchdog, ensuring that the constitutional and legal protections extended to this historically marginalized community are effectively implemented and upheld. Essentially, it is a dedicated institution mandated to protect and promote the rights and welfare of Scheduled Castes across the nation.
At its core, the NCSC derives its authority directly from the Indian Constitution, specifically Article 338. This makes it a 'constitutional body,' signifying its foundational importance and independence from the executive branch.
Unlike statutory bodies, which are created by acts of Parliament, constitutional bodies are enshrined within the Constitution itself, granting them a higher degree of autonomy and permanence. Historically, the journey to establish a dedicated commission for SCs reflects India's evolving commitment to social justice. Initially, a Special Officer for Scheduled Castes and Scheduled Tribes was appointed under Article 338.

The 65th Constitutional Amendment Act of 1990 transformed the Special Officer into a multi-member National Commission for Scheduled Castes and Scheduled Tribes.
Later, the 89th Constitutional Amendment Act of 2003 further bifurcated this joint commission into two distinct bodies: the National Commission for Scheduled Castes (NCSC) under Article 338 and the National Commission for Scheduled Tribes (NCST) under Article 338A.
This bifurcation was a strategic move to allow each commission to focus exclusively on the unique challenges and developmental needs of their respective communities, thereby enhancing their effectiveness.
The NCSC is composed of a Chairperson, a Vice-Chairperson, and three other Members, all appointed by the President of India. Their terms of office and conditions of service are also determined by the President.

It is tasked with investigating and monitoring all matters related to the safeguards provided for SCs, whether under the Constitution, specific laws, or government orders.

Furthermore, the NCSC is responsible for presenting annual and special reports to the President, detailing the working of these safeguards and recommending measures for their effective implementation.

One of the most significant powers vested in the NCSC is its quasi-judicial authority. While investigating matters or inquiring into complaints, it possesses all the powers of a civil court. This means it can summon witnesses, require the production of documents, receive evidence on affidavits, and issue commissions for examining witnesses, giving it substantial investigative teeth to uncover truth and recommend justice.
The NCSC also plays a crucial advisory role, as both the Union and State governments are mandated to consult it on all major policy matters affecting Scheduled Castes. This ensures that the voice and concerns of the SC community are considered at the highest levels of policy formulation.
