Definition

Lokpal and Lokayukta are anti-corruption ombudsman institutions in India designed to investigate allegations of corruption against public servants. The term 'Lokpal' literally means 'protector of people' in Sanskrit, while 'Lokayukta' means 'people's representative.

' These institutions represent India's attempt to create an independent, statutory mechanism to combat corruption at the highest levels of government. The Lokpal operates at the central level and can investigate complaints against central government officials, including the Prime Minister, Ministers, and Members of Parliament.

Lokayuktas function at the state level with similar powers over state government officials. The concept is borrowed from the Scandinavian ombudsman system, particularly Sweden's model established in 1809.

However, unlike traditional ombudsmen who primarily address administrative grievances, Indian Lokpal and Lokayukta have quasi-judicial powers to investigate corruption cases and recommend prosecution.

The institution gained prominence during the anti-corruption movement led by Anna Hazare in 2011, which pressured the government to enact comprehensive legislation. The Lokpal and Lokayuktas Act 2013 finally established these bodies after decades of deliberation, committee reports, and legislative attempts.

The Act creates a multi-member body with both judicial and non-judicial members, ensuring diverse expertise in handling corruption cases. The selection process involves high-level committees including the Prime Minister, Chief Justice of India, and Leader of Opposition, designed to ensure independence and credibility.

These institutions have investigative powers, can conduct preliminary inquiries, and possess prosecution powers through special courts. They also have administrative oversight functions and can recommend disciplinary action against errant officials.

The effectiveness of these institutions depends on their independence, adequate resources, and political will to implement their recommendations. While the central Lokpal was appointed only in 2019, several states had established Lokayuktas much earlier, with Maharashtra being the first in 1972.

The institution represents a significant step in India's governance reform agenda, complementing other accountability mechanisms like the Central Vigilance Commission, Comptroller and Auditor General, and Right to Information Act.
