Definition

Workplace sexual harassment is unwelcome conduct of a sexual nature that undermines dignity, equality or a safe working environment. India's POSH Act, 2013 combines prevention with complaint and redressal institutions.

Its coverage is not confined to physical contact or to a permanent employee sitting in an office. The relevant workplace, person and conduct must be examined under the statute. An Internal Committee or the applicable Local Committee provides a structured process, while sensitivity, confidentiality and fair opportunity to respond support credible fact-finding.

An unproved complaint is not automatically a malicious complaint.
