Police Reforms and Criminal Justice — Basic Structure

Updated 19 Oct 2026

Basic Structure

Follow the justice chain

Information about an offence → lawful investigation → preservation and presentation of evidence → judicial determination → implementation and review. Each stage has a different responsible institution. A failure in one stage cannot be assumed to disappear when another becomes faster.

Match the police reform instrument to its task

  • State Security Commission: broad policy and protection against unwarranted pressure.
  • Police Establishment Board: specified personnel matters.
  • Police Complaints Authority: serious misconduct scrutiny.
  • Tenure safeguards: continuity and professional independence, alongside lawful accountability.
  • Investigation separation: protected specialist capacity, supported by staffing and resources.

The Prakash Singh directions date to 22 September 2006. The MHA's historical account records the framework; it does not establish uniform current State compliance.

The BNS, BNSS and BSA introduced the new substantive, procedural and evidence framework from 1 July 2024, subject to applicable commencement and transitional provisions. A historical CrPC holding should not be assigned a new section number without checking the new law.

Test technology and performance

Audio-video recording and electronic records can improve traceability, but authenticity, custody, lawful access and correction remain necessary. CCTNS began in 2009; ICJS connects parts of the justice process. Count timeliness alongside evidence quality, legality and access. Arrests, registrations and disposal totals alone can reward activity without establishing justice.
