Right to Equality — UPSC Importance
UPSC Importance Analysis
The right to equality is a foundation for GS II analysis of public decisions, discrimination and equal opportunity. It also tests whether a student can distinguish formal sameness from constitutionally relevant differences. The point is not to label each differential measure fair or unfair on appearance, but to examine the applicable provision and reasons for the distinction.
Prepare Articles 14–18 as related guarantees with distinct subjects. Article 14's general protection, Article 15's discrimination provisions, Article 16's public-employment focus, Article 17's abolition of untouchability and Article 18's treatment of titles should not be merged into one undifferentiated rule. The beneficiary and setting of a claim matter.
For Mains, equality provides a framework for examining access, classification and measures addressing disadvantage. A strong answer connects the legal provision with evidence about the barrier and the design of the response. No unsupported case holding or PYQ frequency is required. The most useful examples show why identical procedure can preserve a barrier, while an irrelevant preference can undermine equal treatment despite benevolent language.
