RTI Act Implementation — Revision Notes

Updated 19 Oct 2026

⚡ 30-Second Revision

  • RTI Act, 2005: requests, proactive disclosure, decisions and appeals form a connected process.
  • Sections 4, 6, 7 and 19: disclosure duties, application, decision, appeal.
  • Ordinarily 30 days for a decision; life-or-liberty information has a 48-hour rule.
  • 13 November 2025: DPDP section 44(3) commenced, substituting RTI section 8(1)(j).
  • Access to records and redress of a service grievance are distinct.

2-Minute Revision

Implementation depends on records being created, indexed, retrievable and disclosed where required. A request is not the beginning of the entire transparency system: proactive publication under section 4 can reduce repeated applications.

Section 6 does not require reasons for seeking information. A refusal must be assessed against the applicable law and appeal process, rather than accepted because an official labels a file confidential.

For personal information, use the amended section 8(1)(j) in force from 13 November 2025; do not copy the superseded wording. Section 8(2)'s balance and section 10's severability remain relevant to the structure of analysis.

5-Minute Revision

Follow an application through the system

A resident seeks records supporting a claimed road repair. Identify the authority holding the work order, estimate and payment record. Specify the records and period clearly. Track receipt, the applicable decision period and any lawful transfer or fee communication. If access is denied, identify the stated exemption and the appeal route rather than assuming that a public-interest assertion automatically resolves the issue.

Diagnose an implementation failure

Missing records, poor indexing, delayed decisions and an unjustified refusal are different problems. Training alone may not fix a record-management failure; digitisation alone may not make an exemption decision lawful. Proactive publication should be usable and understandable, not merely a large unsearchable upload. Compare performance with the legal obligation actually involved.

Explain the amendment carefully

The 2023 DPDP Act and its 2025 commencement notification must be read together. Commencement of the RTI amendment does not mean that every DPDP provision commenced on the same date. When evaluating transparency and privacy, identify the exact operative provision, the requested information and any applicable disclosure or severability analysis.
