Act 10 of 20092009The Information Technology (Amendment) Act, 2008 (Act 10 of 2009) introduced specific offences including identity theft under section 66C, cheating by personation through a computer resource or communication device under section 66D, and cyber terrorism under section 66F. These were statutory changes to the 2000 Act, not amendments to the Constitution. The offence definitions attach different mental elements and conduct requirements.A stolen credential used dishonestly, a fraudulent impersonation and a qualifying attack on national security require different legal analysis. The additions help students classify a cyber incident by conduct, intention and consequence rather than call every fraud cyber terrorism. Section 66F has demanding statutory ingredients: a service disruption is not automatically terrorism merely because a computer was involved.
