42nd Amendment Act1976This amendment, often called a 'Mini-Constitution,' added four new Directive Principles and significantly altered the relationship between FRs and DPSPs. It inserted Article 39A (free legal aid), Article 43A (participation of workers in management), and Article 48A (protection and improvement of environment). It also amended Article 38 to secure opportunities for healthy development of children and Article 39 to protect children and youth against exploitation.Strengthened the socialist and environmental dimensions of DPSPs, giving them greater constitutional weight. It also attempted to give primacy to DPSPs over FRs, which was later struck down by the Supreme Court in the Minerva Mills case, emphasizing the basic structure doctrine of harmony between FRs and DPSPs.
44th Amendment Act1978This amendment added one more DPSP, Article 38(2), which directs the State to minimize inequalities in income, status, facilities, and opportunities, not only amongst individuals but also amongst groups of people residing in different areas or engaged in different vocations.Further reinforced the commitment to social and economic justice, particularly focusing on reducing disparities across various segments of society. It aimed to make the pursuit of equality a more explicit and comprehensive goal for the State.
86th Amendment Act2002This amendment changed the subject matter of Article 45. It made elementary education a Fundamental Right under Article 21A for children aged 6-14 years. Consequently, Article 45 was amended to direct the State to provide early childhood care and education for all children until they complete the age of six years.Elevated the right to education for a specific age group from a DPSP to a Fundamental Right, making it legally enforceable. It redefined the State's obligation for early childhood care, emphasizing holistic development before formal schooling, while ensuring the right to education for older children.
97th Amendment Act2011This amendment added a new DPSP, Article 43B, which directs the State to promote voluntary formation, autonomous functioning, democratic control, and professional management of co-operative societies.Provided constitutional protection to cooperative societies, recognizing their role in economic development and social empowerment. It aimed to foster a genuine cooperative movement by ensuring their democratic and autonomous functioning, aligning with Gandhian principles of decentralized economic activity.
