SC/ST Prevention of Atrocities Act — Prelims Strategy
Prelims Strategy
Read the relevant clause before drawing a conclusion from a scenario. Identify the protected person, alleged conduct, perpetrator category where specified and other required circumstances. A correct constitutional reference does not independently establish each element of a statutory offence. Equally, a civil-sounding label cannot rule out criminal conduct where the elements are present.
Keep procedural stages separate. FIR registration begins a formal process; arrest depends on the applicable necessity and law; conviction requires the judicial determination. Section 18A's removal of specified prior barriers should not be read as automatic guilt or mandatory arrest in every allegation. The 2018 change is statutory, not a constitutional-amendment number.
Distinguish court arrangements from support rights. Section 14 concerns the special forum, while section 15A concerns victims and witnesses. A hearing notice and practical ability to attend are related but different. In institutional questions, ask what function the provision performs rather than accepting an option because it contains a familiar legal term.
