Constitutional Framework for Minorities — Amendments

93rd Amendment Act	2006	Inserted Clause (5) into Article 15, enabling the State to make special provisions for the advancement of any socially and educationally backward classes of citizens or for the Scheduled Castes or the Scheduled Tribes in relation to their admission to educational institutions, including private educational institutions, whether aided or unaided, other than minority educational institutions referred to in Article 30(1).	While not directly amending Articles 29 or 30, this amendment significantly impacted the scope of reservations in educational institutions. By explicitly excluding minority educational institutions from the purview of reservations for SC/ST/OBC in private unaided institutions, it implicitly reaffirmed the special protection accorded to minority institutions under Article 30(1) as interpreted by the Supreme Court in cases like P.A. Inamdar and T.M.A. Pai Foundation. This highlights the unique constitutional position of minority institutions.
