Maintenance Tribunals — Basic Structure
Basic Structure
Identify the claimant and relationship
The 2007 Act separately defines a senior citizen and a parent. Senior citizenship uses a sixty-year threshold, but a parent may be younger. Children include the specified adult descendants, while the relative category for a childless senior citizen has a particular property and inheritance connection. Everyday kinship alone does not settle liability.
Locate the institutions
Section 7 provides for Maintenance Tribunals at subdivision level, presided over by officers of at least Sub-Divisional Officer rank. Section 15 concerns district Appellate Tribunals with at least District Magistrate rank. The section 18 Maintenance Officer assists by representing a parent who so desires; that role is separate from adjudication.
Follow the process
Applications, authorised assistance where the claimant is incapable, suo motu cognisance and interim maintenance are part of the framework. Notice, evidence and an opportunity to be heard remain important. The section 5(4) period runs from service of notice, with a limited exceptional extension.
Match the remedy to the facts
Monthly maintenance differs from the conditional-transfer remedy under section 23. A property gift is not automatically revocable merely because relations deteriorate. Finally, distinguish a maintenance order from verified payment. An effective review follows the same cohort through adjudication and compliance rather than comparing unrelated annual totals.
