GI Rules 20202020The Geographical Indications of Goods (Registration and Protection) (Amendment) Rules, 2020, notified as G.S.R. 528(E) on 26 August 2020, replaced rule 56. An applicant seeking authorised-user registration must provide a statement explaining the claim to be a producer of the registered GI, send a copy to the registered proprietor and inform the Registrar. The amendment also changed rule 59’s registration-and-certificate procedure after advertisement and the opposition stage. It concerns producers’ access to authorised-user registration, not automatic registration of every craft from a region. For a hypothetical Kashmir craft producer working with an already registered GI, distinguish the product’s GI registration from that producer’s authorised-user status. Regional residence or a shop’s advertising alone does not supply the required producer case. The artisan should be able to identify the particular registered indication and the basis of the production claim. This historical amendment illustrates how legal recognition can reach individual producers; it does not certify a named seller, confer a GI on all Kashmir crafts, or claim that the 2020 text is the entire current procedural rulebook.
