| Act 19 of 2022 | 2022 | The Energy Conservation (Amendment) Act, 2022 expanded the definition of energy to cover fossil, non-fossil and renewable sources. It inserted section 14(x), empowering the Central Government to specify minimum shares of non-fossil consumption by designated consumers as energy or feedstock. Different shares may be specified for different kinds of non-fossil sources and different designated consumers. The Bureau’s functions were correspondingly expanded to include recommendations on these requirements. | This changes the policy instrument from a general preference for cleaner sources to authority for specified consumption obligations. The denominator matters: a share of consumption is not the same measure as a share of installed electricity-generating capacity. Non-fossil and renewable are also not interchangeable categories. The amendment itself does not set one universal percentage for every consumer; the applicable notification, consumer category and accounting period must be identified before making a compliance calculation. |
