Fair Treatment — Mains Strategy

Mains Strategy

Begin with a working criterion: fair treatment uses relevant reasons and makes the process accessible and reviewable. Then distinguish identical treatment from justified differentiation. A short example, such as correcting a service outage or providing an accessible waiting arrangement, can show the difference without requiring a lengthy legal discussion.

In the body, examine both the decision and procedure. State the lawful purpose, the evidence, the criterion and how comparable cases will be handled. Add an opportunity to correct factual errors and a reasoned explanation. If resources are scarce, compare the proposed allocation method with a plausible alternative and explain why it fits the objective.

Conclude with a generalisable safeguard: an unfamiliar applicant with the same relevant circumstances should be able to obtain the same treatment. Do not promise that fairness eliminates every disadvantage or that discretion is inherently wrong. A case-study answer should show how discretion is constrained by reasons, records and review while retaining the ability to respond to relevant needs.
