Indian Independence Act 1947 — Prelims Strategy
Prelims Strategy
Attach a verb to each date: 18 July 1947—royal assent; 15 August 1947—appointed day; 26 January 1950—Constitution in force and republic. A statement can contain a familiar date and still attach the wrong event to it.
Use section numbers as a functional map: 1 creates the Dominions, 6 concerns legislative competence, 7 ends imperial relationships and 8 supplies transitional government. Memorise the legal effects rather than a claim that the Act immediately abolished every inherited institution. Governors-General and an adapted 1935 framework could continue within an independent constitutional setting.
For state-integration questions, distinguish lapse, accession and merger. The Act did not automatically transfer paramountcy or execute every accession. For boundary questions, distinguish provision for a commission award from the final demarcation itself.
Finally, test options about later British legislation against the requirement for Dominion legislative extension. The existence of the Crown in Dominion arrangements should not be used as a shortcut to infer continuing Westminster supremacy over Dominion law.
