Cross-border terrorism refers to acts of violence or intimidation perpetrated by non-state actors who operate from the territory of one state and target another state, often with the implicit or explicit support, patronage, or acquiescence of the host state.

From a legal standpoint in India, the Unlawful Activities (Prevention) Act (UAPA), 1967, as amended, defines 'terrorist act' broadly under Section 15 to encompass actions intended to threaten India's unity, integrity, security, or sovereignty, or to instill terror in the populace.

This includes acts causing death, injury, property damage, or disruption of essential services through the use of lethal weapons or explosives. The 2019 amendments to UAPA further allowed the central government to designate individuals as 'terrorists,' enhancing its ability to target perpetrators directly, irrespective of their organizational affiliation.

[4] Operationally, security agencies view cross-border terrorism as a form of asymmetric warfare, characterized by the clandestine infiltration of trained militants, often armed and equipped, across international borders or the Line of Control (LoC) with the intent to conduct attacks, spread propaganda, or destabilize regions.

This phenomenon is distinct from conventional warfare due to its reliance on non-state proxies and deniability, and from internal insurgency by its external origin and support. The Financial Action Task Force (FATF) also provides an international operational definition by focusing on the financing of terrorism, identifying activities that support terrorist groups, including those operating across borders, as illicit.
