Definition
The National Commission for Scheduled Tribes is the constitutional body under Article 338A that monitors safeguards for Scheduled Tribes, examines complaints and advises on their development and protection.
The 89th Amendment Act, 2003 created the separate constitutional provision, and the NCST was established on 19 February 2004. Its composition includes a Chairperson, Vice-Chairperson and three other members appointed by the President.
Specified civil-court-type powers support inquiry, while recommendations and reporting promote accountability. These powers should not be confused with general judicial jurisdiction or unilateral authority to change Scheduled Tribe lists under Article 342.
