Definition

Federal Structure refers to a system of government where power is constitutionally divided between a central authority (Union Government) and constituent political units (State Governments). In India's context, federalism means the coexistence of the Union Government and State Governments, each having their own sphere of authority as defined by the Constitution.

Unlike a unitary system where all power rests with the central government, or a confederal system where states retain most power, federalism creates a balance where both levels of government are supreme in their respective domains.

India's federal structure is unique because it combines federal features (like division of powers, written constitution, independent judiciary) with unitary features (like single citizenship, integrated judiciary, emergency provisions).

This hybrid nature led constitutional expert K.C. Wheare to describe India as 'quasi-federal' - federal in normal times but unitary during emergencies. The Constitution distributes legislative powers through three lists in the Seventh Schedule: Union List (defense, foreign affairs, currency), State List (police, agriculture, local government), and Concurrent List (education, forests, marriage).

The federal structure ensures that governance is brought closer to people through state governments while maintaining national unity through the Union Government. This system allows for diversity in unity, enabling different states to address local needs while remaining part of a unified nation.

The Supreme Court acts as the umpire in federal disputes, interpreting the Constitution and resolving conflicts between different levels of government. India's federalism has evolved from 'cooperative federalism' in early decades to 'competitive federalism' in recent times, with states competing to attract investment and improve governance.

The federal structure also accommodates India's diversity through provisions like Article 371 which grants special status to certain states, creating an asymmetric federal arrangement.
