Fundamental Rights are basic human rights guaranteed by the Indian Constitution to protect the dignity and freedom of individuals. Think of them as your constitutional shield against arbitrary government action and social discrimination.
These rights are called 'fundamental' because they are essential for the all-round development of human personality and are necessary for maintaining human dignity. They are justiciable, meaning you can approach courts if these rights are violated.
The Constitution guarantees six categories of Fundamental Rights: Right to Equality (Articles 14-18), Right to Freedom (Articles 19-22), Right against Exploitation (Articles 23-24), Right to Freedom of Religion (Articles 25-28), Cultural and Educational Rights (Articles 29-30), and Right to Constitutional Remedies (Article 32).
Alongside these rights, the 42nd Amendment in 1976 added Fundamental Duties under Article 51A, which are moral and civic obligations of citizens. Unlike rights, duties are non-justiciable, meaning courts cannot enforce them directly, but they serve as constant reminders of our responsibilities toward the nation.
The concept of Fundamental Rights draws inspiration from the American Bill of Rights, while Fundamental Duties are inspired by the Soviet Constitution. These rights are not absolute and can be subject to reasonable restrictions in the interest of public order, morality, health, and security.
During national emergency, some rights can be suspended, but the core right to life and personal liberty remains protected. The Supreme Court, through landmark judgments like Kesavananda Bharati (1973), has established that Fundamental Rights form part of the basic structure of the Constitution and cannot be destroyed by amendments.
This balance between rights and duties, individual freedom and social responsibility, makes the Indian constitutional framework unique and comprehensive.
