Atomic Energy 20152015The Atomic Energy (Amendment) Act, 2015 carries Act number 5 of 2016. Section 2 changed the government-company definition to include a company wholly owned by qualifying government companies, with the required Government control over its board. Section 3 tied specified atomic-energy licences to government entities or government companies and addressed loss of that status. This was a historical mechanism for government-company joint ventures, not a general opening to private ownership.Ownership eligibility and a nuclear licence are separate questions. The 2015 amendment explains an earlier governance model; it is not a complete statement of present licensing law. The SHANTI Act, 2025 (Act 39 of 2025) subsequently enacted a replacement framework, including repeal and savings in section 91. Its section 1(2) requires notified commencement and permits different dates for different provisions. Read the transition with the applicable commencement notifications rather than assuming either that the old restriction remains unchanged or that assent activated every new provision.
