Constitutional and Legal Framework — Other Backward Classes (OBCs) — UPSC Importance
UPSC Importance Analysis
The OBC framework connects substantive equality, representation and federalism. It explains why formal eligibility alone may not address accumulated social and educational barriers, while also requiring that corrective measures have a defined legal basis and scope. The analytical challenge is to justify and evaluate an intervention without treating reservation as one undifferentiated rule.
For Prelims, distinguish Articles 15 and 16, initial appointment and promotion, and Central and State identification. The 1951, 2005, 2018 and 2021 amendments provide concrete anchors, with the Act year kept separate from commencement where they differ. An institutional status change should not be confused with an automatic change to every person's eligibility.
For Mains, examine representation, access, internal distribution and implementation. Transparent criteria and usable application processes matter alongside the enabling constitutional provision. A strong answer can explain both the corrective rationale and the limits of a particular entitlement, while avoiding unsupported percentages or the assumption that a commission replaces every implementing authority.
