Basic Structure

Keep the articles separate

Article 338B establishes the NCBC's constitutional framework. Article 342A addresses socially and educationally backward-class lists. The 102nd Amendment Act, 2018 inserted these provisions; the 105th Amendment Act, 2021 addressed the Central–State distinction and the related consultation proviso.

Identify the institution

The Commission consists of a Chairperson, Vice-Chairperson and three other members appointed by the President through the specified warrant. It monitors safeguards, inquires into complaints, advises on socio-economic development and evaluates progress. Civil-court-type evidence powers operate within specified inquiries rather than as general judicial jurisdiction.

Read the list distinction

Under Article 342A(3), States and Union territories may by law maintain lists for their own purposes, with entries that may differ from the Central List. State inclusion alone therefore does not settle a Central Government policy question. Article 338B(9)'s consultation proviso excludes the purposes of Article 342A(3); it does not abolish the Commission's wider functions.

Follow reports and outcomes

Reports go to the President for parliamentary laying with a response memorandum. For State matters, Article 338B(7) specifies the State Government for laying before the State Legislature. This differs from the NCST's Governor wording. A summons seeks evidence, a recommendation proposes action and implementation records what happened afterwards. None of those stages should be silently substituted for another.
