Occupational Safety and Health (OSH) refers to the discipline concerned with protecting the safety, health, and welfare of people engaged in work or employment. From a UPSC perspective, it's a critical area within social justice and labor rights, encompassing a complex interplay of constitutional mandates, statutory provisions, international conventions, and administrative mechanisms.

Historically, India's OSH framework was fragmented, with numerous laws governing different sectors – factories, mines, plantations, construction, etc. This led to complexities in compliance, enforcement, and often, inadequate protection for a vast segment of the workforce, particularly in the unorganized sector.

The recent Occupational Safety, Health and Working Conditions Code, 2020 (OSH Code 2020), represents a significant reform. It consolidates 13 existing central labour laws relating to safety, health, and working conditions into a single code, aiming for universal applicability, simplified compliance, and enhanced worker protection.

This Code seeks to cover a much wider array of establishments and workers, including those in the gig economy and platform work, which were largely outside the purview of older laws.

OSH encompasses a broad spectrum of activities: identifying various types of workplace hazards (physical, chemical, biological, ergonomic, psychosocial), conducting risk assessments, implementing safety management systems, providing personal protective equipment (PPE), ensuring proper training and supervision, establishing emergency preparedness plans, and instituting mechanisms for accident reporting, investigation, and compensation.

It also involves regular health surveillance of workers exposed to specific hazards and maintaining industrial hygiene standards. The enforcement of these provisions is carried out by various regulatory bodies, primarily the Directorate General of Factory Advice Service & Labour Institutes (DGFASLI) at the central level and State Factory Inspectorates and Labour Commissioners at the state level.

From a practical standpoint, OSH is crucial for both workers and the economy. For workers, it ensures their physical and mental well-being, dignity, and ability to earn a livelihood without fear of injury or illness.

For employers, it leads to increased productivity, reduced absenteeism, lower insurance costs, and improved morale. For the nation, robust OSH standards contribute to human capital development, reduce the burden on public health systems, and enhance India's image as a responsible global economic player.
