Labor Rights and Social Security — Basic Structure
Basic Structure
Separate rights at work from protection against risk
Rights at work concern the conditions under which labour is performed: payment, safety, fair treatment and routes for resolving disputes. Social security concerns support against defined contingencies. An accident can involve both a safety failure and a claim under an applicable benefit framework.
Identify the legal and administrative layers
The four Labour Codes were brought into implementation from 21 November 2025, consolidating 29 central labour laws. Their names correspond to wages, industrial relations, social security, and occupational safety and working conditions. A Code's commencement does not establish that each contemplated scheme or detailed benefit is immediately payable to each worker.
Read the Code, applicable rules and notifications, scheme eligibility and actual delivery arrangements as separate layers. The March 2026 ministry FAQ illustrates the importance of dated clarification. Do not turn a statement about a notification pending in March into an unsupported claim about its status in October.
Classify the work relationship carefully
Direct fixed-term employment and contract labour are different arrangements. A short duration alone does not make them identical. Gig and platform work also require their statutory distinctions; use the actual relationship rather than the vocabulary used by a business.
Evaluate practical protection
Ask whether workers know the entitlement, can establish eligibility, receive the service or payment and obtain correction when denied. Contribution, registration and benefit receipt are different events. Portability, accessible claims and effective enforcement matter alongside the text of a right.
