Articles 15(4) and 16(4) are constitutional provisions that enable the Indian state to implement positive discrimination or affirmative action policies. These articles represent a fundamental departure from the general principle of equality by allowing the government to make special provisions for disadvantaged groups.

Article 15(4), added through the First Constitutional Amendment in 1951, permits the state to make special provisions for the advancement of socially and educationally backward classes, Scheduled Castes, and Scheduled Tribes in educational institutions.

This means the government can reserve seats in colleges, universities, and schools for these communities. Article 16(4), which was part of the original Constitution, allows the state to reserve appointments or posts in government services for backward classes that are not adequately represented.

Together, these provisions form the constitutional foundation for India's reservation policy. The key distinction is that Article 15(4) deals with educational reservations while Article 16(4) covers employment reservations in government services.

These articles are exceptions to the general equality provisions in Articles 14, 15(1), and 16(1), creating what legal scholars call 'protective discrimination.' The constitutional framers recognized that formal equality alone would not address centuries of social discrimination and economic disadvantage faced by certain communities.

Therefore, these provisions enable substantive equality by providing preferential treatment to historically marginalized groups. The scope of these articles has evolved through various constitutional amendments and judicial interpretations.

The 93rd Constitutional Amendment in 2005 added Article 15(5), extending reservation benefits to private educational institutions. Article 16(4A), added through the 77th Amendment in 1995, specifically provides for reservations in promotions for SC/ST employees.
