Constitutional and Legal Framework — Other Backward Classes (OBCs) — Definition
Definition
The OBC constitutional and legal framework uses equality provisions, enabling measures and institutions to address social and educational backwardness and inadequate representation. Its provisions differ by purpose: education, public employment and identification of beneficiary classes do not share one universal rule.
Article 340 concerns backward-class commissions, Article 338B gives the NCBC constitutional status, and Article 342A distinguishes relevant identification powers. Understanding the framework requires matching a policy to its legal basis, beneficiary category and institutional scope.
A community's recognition for one purpose does not automatically establish eligibility under every Central or State scheme.
