PRINCIPLE: A person who carries on a hazardous or inherently dangerous activity is absolutely liable for any damage caused by that activity, regardless of the care taken or precautions adopted. No negligence need be proven, and no defense of reasonable care or accident is available. The liability arises solely from the nature of the enterprise itself.
FACTUAL SCENARIO: Rajesh operates a chemical manufacturing plant in an industrial zone. On 15th March, despite installing modern safety equipment, employing trained personnel, and maintaining all statutory compliance, a chemical reaction in Storage Tank B unexpectedly caused an explosion. The explosion damaged three neighboring properties—a printing press owned by Amit, a textile workshop owned by Priya, and a residential building owned by Kumar.
Rajesh's safety officer submitted evidence that the explosion occurred due to a rare interaction between two chemicals that industry experts had not previously documented. The plant had never experienced such an incident in twenty years of operation. Rajesh's insurance company argued that since Rajesh had exercised utmost care and the incident was unforeseeable, he should not be held liable.
